  • A Leavenworth woman accused of leaving her baby alone in an alley will undergo a competency evaluation.
    District Judge Gunnar Sundby ordered the evaluation for Elizabeth A. Michaud Friday at the request of defense attorney Elaine Halley.
    Michaud is charged with aggravated endangering a child for allegedly leaving her infant son alone May 3 in an alley in Leavenworth.
    Authorities believe Michaud was under the influence of drugs or alcohol the night of the incident. Leavenworth Police Chief Pat Kitchens has estimated the baby was in the alley, which was a few blocks from Michaud's home, for at least three hours before he was found in a stroller by an area resident.
    Sundby said competency evaluations usually take about 10 days. He scheduled another court appearance in two weeks.
    "The case is suspended until Dec. 19 at 9 o'clock," he said.
    The judge said he hopes the evaluation will be completed by this date.
    Michaud was in the custody of officers from the Leavenworth County
    Jail when she appeared Friday in court.
    Michaud previously had been free on bond, but a bench warrant was issued for her arrest when she failed to show up last week for a scheduled court appearance. Assistant County Attorney Cheryl Marquardt reported at the time that the defendant apparently had walked out of a treatment program Nov. 24.
    Michaud appeared in court Monday after she had been taken into custody on the bench warrant. Michaud said Monday she had left rehab because one of her children was in an accident.
    Halley did not appear with her client Monday. And Sundby scheduled Friday's court appearance so the defense attorney would be available to appear with Michaud.
    After Sundby said Friday that he would order a competency hearing, Halley said her client was requesting a chance to go back into treatment.
    The judge said at this point he wants to make sure Michaud understands the nature of the court proceedings by having her undergo a competency evaluation.
