  • While the attorney for a man accused of killing two men in Leavenworth said the defense is ready for the case to go to trail, the lawyer would like to have a transcript of a preliminary hearing.
    The transcript issue came up during a status hearing Friday in the case of Aundray D. McDonald.
    McDonald, 37, is charged with premeditated first-degree murder, first-degree felony murder, criminal discharge of a firearm at an occupied vehicle and criminal possession of a firearm by a convicted felon. He is accused of killing two brothers, Derrick and Marshall Jones, Dec. 16, 2011, in Leavenworth.
    “I certainly would like to have that transcript,” defense attorney Carl Cornwell said Friday in court.
    He said McDonald’s family is trying to secure the money to pay for the transcript.
    The preliminary hearing was held Nov. 29. A jury trial is scheduled to begin March 18.
    District Judge Gunnar Sundby scheduled another hearing for this Friday to check on the status of the transcript.
    McDonald, who’s in the custody of the Kansas Department of Corrections, did not appear for last week’s hearing but Cornwell appeared on his behalf.
