A Leavenworth man accused of involuntary manslaughter in connection to a fatal shooting appeared in court Friday.
Justin M. Driscoll, 26, is charged with involuntary manslaughter for the death of Dick Mathis.
Mathis, 30, died July 13 after he was shot in the chin while he was a passenger in a pickup truck in the area of 18th and Cherokee streets, according to police.
The criminal complaint used to charge Driscoll alleges that reckless behavior was a factor in the alleged crime.
During Friday's court appearance, District Judge Gunnar Sundby asked the parties in the case if they were ready to scheduled a preliminary hearing. But defense attorney KiAnn McBratney requested that another status hearing be scheduled in the case.
"The state and I are discussing a possible disposition," McBratney said.
A status hearing was scheduled for Oct. 11.
