CHARTER ORDINANCE NO.  1-2008CHARTER ORDINANCE EXEMPTING THE CITY OF LANSING, KANSAS FROM K.S.A. 14-201 RELATING TO THE ELECTION AND APPOINTMENT OF CERTAIN OFFICERS IN CITIES OF THE SECOND CLASS AND PROVIDING ON THE SAME SUBJECT, AND REPEALING CHARTER ORDINANCES 3-83, 1-85, 1-90, 1-92, 1-93, 1-96 and 2-2002.Section 1.    The City of Lansing, Kansas, by the power invested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects and exempts itself from and makes inapplicable to it the provisions of K.S.A. 14-201 as amended, relating to the election of officers in cities of the second class and provides substitute and additional provisions as hereinafter provided. Section 2.    There shall be elected on the first Tuesday in April 2005 the Mayor and one council member, designated as Council Member A from each ward of the city.  There shall be elected on the first Tuesday in April 2007 one council member, designated as Council Member B from each ward of the city.  The Mayor and council members, regardless of their designation, shall hold their offices for a term of four (4) years.  The purpose of this section is to stagger the terms of the governing body members to avoid an inexperienced city council taking offices all at the same time. Section 3.    The Mayor elected on the first Tuesday of April, 2009 shall serve until the first regular meeting of the City Council in January, 2013.  An election for the office of Mayor shall be conducted on the first Tuesday of November, 2012, and the person so elected shall take office beginning with the first regular meeting of the City Council in January, 2013 and shall serve a term of four (4) years.  Thereafter, an election for the office of Mayor shall be conducted on the first Tuesday in November every four (4) years and the person so elected shall take office beginning with the first regular meeting of the City Council in January of the year following the date of the election. Section 4.    The Mayor shall appoint, by and with the consent of the council, a city administrator and any other position the governing body deems necessary to appoint .   Section 5.    Any officers appointed and confirmed shall hold an initial term of office of not to exceed one year and until their successors are appointed and qualified. Any officers who are reappointed shall hold their offices for a term of one year and until their successors are appointed and qualified. The council shall by ordinance specify the duties and compensation of the office holders, and by ordinance may abolish any office created by the council whenever deemed expedient.Section 6.    The City Administrator shall appoint and hire all other city employees or independent contractors. Section 7.    Charter Ordinances 3-83, 1-85, 1-90, 1-92, 1-93, 1-96 and 2-2002 are hereby repealed.Section 8.     This Charter Ordinance shall be published once a week for two (2) consecutive weeks in the official city newspaper.Section 9.    This Charter Ordinance shall take effect sixty-one (61) days after its final publication, unless a sufficient petition for a referendum is filed and a referendum held on this Charter Ordinance as provided in Article 12, Section 5, Subsection (c) (3) of the Constitution of the State of Kansas, in which case this Charter Ordinance shall become effective if approved by a majority of the electors voting thereon.Passed and approved by the Governing Body, not less than two-thirds of the members elect voting in favor thereof, this 6th day of November, 2008.{SEAL}                                        Kenneth W. ORDINANCE NO. 828AN ORDINANCE LEVYING ASSESSMENTS FOR UNPAID CHARGES AGAINST EACH LOT & PARCEL OF GROUND AS A SPECIAL ASSESSMENT TO CONSTITUTE A LIEN UPON THE PROPERTY FOR THE AMOUNT OF DELINQUENT FEES FOR WEED REMOVAL ASSESSMENTS OF THE CITY OF LANSING, KANSAS.WHEREAS, said governing body of the city of Lansing, Kansas has determined that the cost for said services rendered be levied and assessed against each lot or parcel of ground for the unpaid charges as a special assessment, which shall constitute a lien upon the property for the amount of said delinquent fees, and after due notice, pursuant to Chapter VIII.
