A Leavenworth woman is accused of attempting to hide a knife she removed from a vehicle after her husband was shot earlier this month, according to a probable cause affidavit.

A Leavenworth woman is accused of attempting to hide a knife she removed from a vehicle after her husband was shot earlier this month, according to a probable cause affidavit.

The document alleges Heather D. Garcia, 41, tried to hide a knife that had been in her husband’s possession.

Her husband, Antonio Garcia Jr., died after he was shot by a police officer July 11 in Leavenworth. Heather Garcia was arrested the same night and has been charged with a misdemeanor count of interfering with law enforcement for allegedly tampering with evidence. She has been released on bond.

The probable cause affidavit, which was prepared to support the charge, initially was sealed. But the document has been released by a judge.

The document was prepared by Heather Vogel, a detective with the Leavenworth Police Department, based on information from police officers’ reports.

According to the affidavit, additional officers were responding to the scene after the shooting. Officers were told Antonio Garcia Jr. had knife inside a vehicle. Heather Garcia reportedly was standing in the area of a door jam to the vehicle.

Heather Garcia had been told several times to move away, but she allegedly refused.

An officer reportedly observed Heather Garcia pick up something and place it down her shirt. The officer grabbed her and placed her in investigative detention, according to the affidavit.

Another officer searched Heather Garcia. When asked if she had a weapon, Heather Garcia reportedly said she had a knife.

An opened pocket knife was found in Heather Garcia’s bra, according to the affidavit.

Police believe this is the same knife that reportedly had been in the possession of Antonio Garcia Jr.

Heather Garcia is next scheduled to appear in court Aug. 16.

The Kansas Bureau of Investigation is investigating the shooting of her husband.
