A new court date has been scheduled for the wife of a man who was fatally shot by a Leavenworth police officer.

Heather D. Garcia, 41, Leavenworth, is charged in Leavenworth County District Court with a misdemeanor count of interfering with law enforcement for allegedly tampering with evidence.

She is accused of attempting to hide an opened pocket knife she removed from a vehicle after her husband, Antonio Garcia Jr., was shot July 11 by a police officer in Leavenworth. Authorities believe the knife had been in the possession of Antonio Garcia Jr., according to a probable cause affidavit filed in the case.

Antonio Garcia Jr. was pronounced dead at the scene.

Heather Garcia has pleaded not guilty to the charge. She appeared in court Wednesday with her attorney, Christopher Bowers.

Bowers said he had just received the last of the evidence from the prosecution as part of the discovery process.

He asked the judge to schedule another status hearing in the case.

The case was continued until Oct. 25.

Heather Garcia remains free on bond while her case is pending.

The shooting of her husband is being investigated by the Kansas Bureau of Investigation.
