A rural Tonganoxie man who escaped from the Leavenworth County Jail earlier this year has been sentenced to an additional 30 days in jail.

George J. Burgess Jr., 39, was sentenced Wednesday in Leavenworth County District Court for a misdemeanor charge of escape from custody.

Burgess reportedly escaped from the custody of the jail July 20 by running away from an unsecured area. He was a trusty who was working outside of the Leavenworth County Jail at the time, but he was still inside the Justice Center building.

Burgess was apprehended Aug. 13 in Lawerence, according to Sgt. Amy Rhoads of the Lawrence Police Department.

He pleaded no contest to the escape charge Nov. 1, according to court records.

In court Wednesday, Assistant County Attorney Michael Jones said Burgess already was serving a jail sentence for a domestic-related battery case at the time of the escape.

Jones said Burgess has been in jail for 122 days since he was captured April 13. But Jones said this time should be counted toward Burgess' earlier sentence.

A pre-sentencing investigation report that was prepared for the case recommended a 12-month jail sentence for the escape.

Burgess' attorney, Gary Fuller, asked District Judge Gunnar Sundby to consider probation for the defendant.

Fuller said his client's criminal history consisted of misdemeanors, many of which were traffic cases.

Fuller blamed his client's escape on an emotion overload that occurred after Burgess learned his wife had been diagnosed with breast cancer.

When given the opportunity to speak Wednesday, Burgess said his family wanted him home for Christmas.

“I know I made a mistake,” he said. “It's a serious mistake. It was stupid.”

Sundby said a year-long jail sentence that ran consecutive to the earlier sentence would be too harsh. The judge imposed a 30-day sentence to run consecutive to whatever Burgess already was serving.
