An attorney for Barbara M. Frantz argued in favor of the request Tuesday in Leavenworth County District Court.

Frantz, 52, was convicted last month of first-degree murder.

She was charged after her husband, Gary, was shot six times Jan. 27, 2017, in a parking lot in downtown Leavenworth.

Frantz has not yet been sentenced.

Defense attorney Stacey Schlimmer said Tuesday that Frantz’s family have been paying for defense services but they no longer have the finances for the additional investigative services.

“They used a lot of resources defending her,” Schlimmer said.

District Judge Michael Gibbens noted an affidavit from Frantz indicates $100,000 has been paid for defense services.

Schlimmer said defense attorneys are seeking to have Frantz declared partially indigent. Defense attorneys also are seeking approval for the investigative services.

Funding for the services would come from the State Board of Indigents’ Defense Services.

Schlimmer said an investigator is needed to obtain recordings and talk to witnesses.

Gibbens said that when he was an attorney, he talked to witnesses himself.

Schlimmer said defense attorneys run the risk of becoming witnesses themselves regarding what witnesses have told them. If they become witnesses, the attorneys would have to withdraw from the case.

“We don’t want to become witnesses,” she said.

Gibbens made no ruling Tuesday but said he will take the matter under advisement.

The judge said he has not seen a case in which an investigator was appointed after a trial.

“The statute seems to be vague to me,” Gibbens said. “It doesn’t say one way or the other.”

Defense attorneys also are seeking State Board of Indigents’ Defense Services funding for transcripts.

Gibbens said he also will review this request.
