With the possibility of a court furlough interrupting a trial, a continuance was granted Friday in a local capital murder case.

Sedale L. Fox’s trial had been scheduled to start March 22, but it is now set to begin April 19.

District Judge Gunnar Sundby said the chief justice of the Kansas Supreme Court has indicated budgetary problems may result in court personnel being placed on furloughs. Dates have been proposed for the furloughs, and Fox’s trial may have been impacted without the continuance.

Fox, 24, is charged with capital murder and conspiracy to commit first-degree murder.

He is accused of murdering his pregnant girlfriend, Olivia Jackson, Jan. 22, 2008, in Lansing, which also resulted in the death of her unborn child.

Fox also is accused of plotting to kill Jackson in a Jan. 11, 2008, bombing in Leavenworth.

The prosecution will be seeking the death penalty if Fox is convicted of capital murder.
