A tentative trial date has been set for a prison inmate accused of sexually assaulting a female guard at the Lansing Correctional Facility.

Rico Glynn, 29, did not appear in Leavenworth County District Court Tuesday because a continuance was requested for a motion hearing. But Judge Gunnar Sundby said he wanted to tentatively schedule a jury trial for Feb. 23.

Sundby said he wanted to have some sort of ending date. He also said the trial date gives the incoming county attorney, Todd Thompson, a deadline.

Glynn is accused of attacking a female correctional officer in June 2005 at LCF. He is charged with aggravated battery of a law enforcement officer, aggravated sexual battery and aggravated kidnapping.

Defense attorney Michael Willcott said a person associated with the case had asked if the hearing planned for Wednesday could be held on another day because of a family issue.

Willcott said he didn’t have a problem with continuing the hearing. He said a scheduled transport of Glynn to the county’s Justice Center by the Kansas Department of Corrections had been halted.

The motion hearing was rescheduled for Jan. 15.
