An arraignment has been continued for a Leavenworth man accused of battering his infant son.

Robert F. Green, 22, appeared Friday in Leavenworth County District Court for what was scheduled to be his arraignment. But the arraignment was continued until next week.

Green is charged with two counts of aggravated battery. The crimes are alleged to have occurred between Aug. 20 and Sept. 5 in Leavenworth while Green’s son was left in his care.

Green will be asked to enter a plea during the arraignment.

District Judge Michael Gibbens normally presides over the case, but he was absent Friday. District Judge Gerald Kuckelman filled in for Gibbens.

Deputy County Attorney Joan Lowdon said the parties could have moved forward Friday with the arraignment. But she said the arraignment could be continued until next week so Gibbens can set a trial date at the same time.

“That is fine,” defense attorney Joel Rook said. “We can set the arraignment over for next week.”

Kuckelman continued the arraignment until Wednesday morning.

Green remains in custody at the Leavenworth County Jail.
